Trip Tracker Privacy Policy

The Website

At TripTracker, accessible from https://trtr.ca, one of our main priorities is your privacy and the privacy of our visitors. This Privacy Policy document contains types of information that is collected and recorded by TripTracker and how we use it.

Information We Collect

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.

When you register for an account, we may ask for your contact information, including items such as name, email address, telephone number, and general information pertaining to your employment.

TripTracker requires that you enter personal work history as well as submit other work-related information. The reports we generate are only as accurate as the information you provide. Subscribers are required to confirm accuracy of reports prior to use outside of the app (Income Tax preparation, etc.). We cannot be held responsible for any use of these reports.

How We Use Your Information

Your information is correlated and presented to you in a way that makes it easy for you to monitor your work history. Other general uses for your information are:

  • Provide, operate, and maintain our website
  • Improve, personalize, and expand our website
  • Understand and analyze how you use our website
  • Develop new products, services, features, and functionality
  • Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the webste, and for marketing and promotional purposes
  • Send you emails
  • Find and prevent fraud
Log Files

TripTracker follows a standard procedure of using log files. These files keep track of when visitors visit websites. All hosting companies do this and the history makes up a part of hosting services' analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable.

The purpose of the information is used for analyzing trends, administering the site, tracking users' movement on the website, gathering demographic information, and directing areas of development to improvement to users' experiences.

Cookies

Like any other website, TripTracker uses 'cookies'. These cookies are used to store information including visitors' preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users' experience by customizing our web page content based on visitors' browser type and/or other information.

Third-party advertising servers or networks use technologies such as cookies, JavaScript, or Web Beacons, that are used in their respective advertisements and links that appear on TripTracker, which are sent directly to users' browser. These technologies are used to measure the effectiveness of their advertising campaigns and/or to personalize the advertising content that you see on websites that you visit.

Note that TripTracker has no access to or control over these cookies that are used by third-party advertisers.

Please note that in order to respect your wishes, we may need to deactivate/delete your account and/or delete your work history or other details.

Children's Information

Another part of our priority is adding protection for children while using the Internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their children's online activity.

TripTracker does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

General
  • These terms and conditions shall govern your use of this website, https://trtr.ca (herein referred to as Trip Tracker).
  • By using Trip Tracker, you accept these Terms and Conditions unconditionally; accordingly, if you do not agree to these Terms and Conditions, you must not use this service.
  • When you register for an account on Trip Tracker, you will be asked to expressly agree to these Terms and Conditions.
  • We do not restrict your access based on your age. If you are under the age of 13, you must not submit any personal information to our site.
  • Trip Tracker uses cookies. By using Trip Tracker, you consent to the use of cookies in accordance with our privacy policy.
  • We will never ask you to provide any personal or credit card information by email or over the phone.

    • Store personal Trip History data, including payroll data such as paystubs, etc.
    • Download, print, or store pages, reports, and data from our website for personal use or for use by your Accountant.
  • Except as expressly permitted in the above section, or other provisions of these Terms and Conditions, you must not download any material from Trip Tracker or our website, or save such material on your device.
  • You may only use Trip Tracker for your own personal use, and you must not use Trip Tracker for any other purposes.
  • Except as expressly permitted by these Terms and Conditions, you must not edit, or otherwise modify any part of Trip Tracker.
  • We reserve the right to restrict or deny access to all or part of Trip Tracker and our website, at our discretion.
Acceptable Use
  • You must not:
    • Violate the directives set out in the robots.txt file for our website.
    • Circumvent, or attempt to circumvent any access restriction measures on our website.
    • Use Trip Tracker or our website in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
    • Use Trip Tracker or our website to copy, store, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, keystroke logger, rootkit, or other malicious software
    • Conduct any systematic or automated data collection activities, including without limitation scraping, data mining, data extraction, and data harvesting, on or in connection to Trip Tracker or our website without our express written consent.
    • Access or otherwise interact with our website using a robot, spider, or other automated means
    • Use data collected from our website for any direct marketing activity (including but not limited to email marketing, SMS marketing, telemarketing and direct marketing).
  • You must ensure that all the information you provide to us through Trip Tracker or our website is true, accurate, current, complete, and not misleading.
  • Registration and Accounts
    • To be eligible for an account on our website under this section, you must be a resident of Canada or the United States.
    • You may register for an account with Trip Tracker by completing and submitting the account registration form on our website, and by verifying your contact information (email address and/or phone number) using the link we will send you.
    • You may be required to submit payment information to subscribe to Trip Tracker. We will not charge your payment method without notifying you at least seven days prior. If you feel you have been wrongly charged, please contact us immediately.
    • You must not allow any other person to access Trip Tracker or our website by using your account.
    • You must not use any other person's account to access Trip Tracker or our website.
    • You must notify us in writing immediately if you become aware of any unauthorized use of your account.
    • You may cancel your account at any time using the account control panel on Trip Tracker, or by contacting us in writing. Refunds will be issued at our sole discretion.
    • We may cancel, suspend, revoke your account, or edit your account details at any time, at our sole discretion and without notice or explanation.
    Login Details
    • If and when you register for an account with Trip Tracker, you will be asked to submit your email address and a secure password, along with contact information, and general workplace details such as your Home Terminal and Mileage Date.
    • You must keep your password confidential.
    • You must notify us in writing if you become aware of any disclosure of your password.
    • You are responsible for any activity on Trip Tracker arising out of any failure to keep your password confidential.
    Subscription Service
    • You are licensed by subscription to use our service. You will be unable to subscribe to our service without first verifying your email address.
    • If you do not have a valid subscription, you may still be able to access Trip Tracker or our website; however certain features may be disabled or otherwise unavailable.
    • Trip Tracker subscriptions are payable in advance on either monthly or annual subscriptions. We will automatically continue your subscription at the current advertised rate, at the end of the cycle for your current subscription. Your subscription will be renewed at the current period (month or annual) based on your settings at the time of invoicing. We will notify you by the email you verify during your registration process at least seven days prior to your credit card being charged.
    • We reserve the right to limit your abilities based on the status of your subscription at the time.
    • We reserve the right to limit or prevent work history being entered based on your current subscription, or the subscription at the time the work history occured. For example, trial accounts can only enter work history for the previous 21 days.
    • If your payment method returns a declined charge, we will immediately notify you by the email you verify during the registration process, and we will restrict your account access. You will be proivded the opportunity to bring yourself current for no less than 14 days, after which time, your account will be deactivated and trip history will be permanently archived.
    • If your account is deactivated, we will attempt to repopulate our database with your work history details and reactivate your account subject to a minimum $50.00 CAD one-time service charge. Repeated defaulting on payments may result in your account being permanently deactivated.
    • Any fraudulent use of the payment details entered on your account will be dealt with swiftly and to the full extent of the law.
      • If it is determined that you have committed a fraudulent act, we reserve the right to restrict or revoke access to Trip Tracker or our website, and purge your entered work history, paystub, or other provided information without warning.
    Limited Warranties
    • We do not warrant or represent:
      • The completeness or accuracy of the information published on Trip Tracker or our website.
      • The material or Tax-Based law and algorithms on Trip Tracker or this website is up to date.
      • That Trip Tracker or any service on our website will remain available.
    • We will make every effort to ensure the accuracy of the forms and reports generated on Trip Tracker, however we cannot be held liable for the use of the information provided, as it relates to tax preparation, statutes, legislation, employer policies or for any other use.
    • We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation.
    • Except to the extent expressly provided otherwise in these Terms and Conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any Trip Tracker services, or if we stop publishing the website.
    • To the maximum extent permitted by applicable law and subject to the below exclusions, we exclude all representations and warranties relating to the subject matter of these Terms and Conditions, Trip Tracker, our website, and the use of Trip Tracker and our website.
    • Limitations and exclusions of liability:
    • Nothing in these Terms and Conditions will
      • Limit or exclude any liability for death or personal injury resulting from negligence.
      • Limit or exclude any liability for fraudulent misrepresentation.
      • Limit any liabilities in any way that is not permitted under applicable law.
      • Exclude any liabilities that may not be excluded under applicable law.
    • We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control, including, but not exclusively limited to Acts of God.
    • We will not be liable to you in respect of any loss or corruption of any data, database, or software.
    • You accept that Railbuddy Enterprises has an interest in limiting the personal liability of our officers and employees, and having regard to that interest, you acknowledge that we are a Limited Partnership Entity. You agree that you will not bring any claim personally against any of our Officers or employees in respect of any losses you suffer in connection with Trip Tracker or this website, or these Terms and Conditions. This will not limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees.
    Breaches of these Terms and Conditions
    • Without prejudice to our other rights under these Terms and Conditions, if you breach these Terms and conditions in any way, or if we reasonably suspect that you have breached these Terms and Conditions in any way, we may:
      • Send you one or more formal warnings
      • Temporarily suspend your access to Trip Tracker or our website
      • Suspend or delete your account on Trip Tracker or our website
      • Permanently prohibit you from accessing Trip Tracker or our website
      • Contact any or all of your Internet service providers and request they block your access to Trip Tracker or our website
      • Commence legal action against you, whether for breach of contract or otherwise
    • Where we suspend, prohibit, or block your access to Trip Tracker, to our website, or to a part of our website, you must not take any action to circumvent such suspension, prohibition, or blocking, including without limitation the creation of and/or use of another account.
    Modifications
    • We may revise these Terms and Conditions from time to time.
    • We will give you written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of Trip Tracker or our website from the date that we give you such notice.
    • If we revise these Terms and Conditions, we will ask for your express agreement to any revision of these Terms and Conditions. If you do not agree to the revised Terms and Conditions, or you do not give your express agreement to the revised Terms and Conditions within such period as we may specify, we may disable or delete your account.
    Assignment
    • You agree that we may assign, transfer, sub-contract, or otherwise deal with our rights and/or obligations under these Terms and Conditions.
    • You may not, without our prior written consent, assign, transfer, sub-contract, or otherwise deal with any of your rights and/or obligations under these Terms and Conditions.
    Severability
    • If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provision will continue to be in effect.
    • If any unlawful and/or unenforceable provision of these Terms and Conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted and the rest of the provision will continue to remain in effect.
    Third-Party Rights
    • A contract under these Terms and Conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.
    • The exercise of the parties' rights under a contract under these Terms and Conditions is not subject to the consent of any third party.
    Entire Agreement
    • Subject to the Limitations and Exclusions of Liability, these Terms and Conditions, together with our Privacy Policy, shall constitute the entire agreement between you and us in relation to your use of our website, and shall supersede all previous agreements between you and us in relation to your use of our website.
    Jurisdiction
    • These Terms and Conditions shall be governed by and construed in accordance with British Columbia and Canadian law.
    • Any disputes relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of British Columbia.
    Statutory and Regulatory Disclosures
    • Trip Tracker is a subsidiary of Railbuddy Enterprises. Railbuddy Enterprises is Incorporated with Industry Canada and the City of Revelstoke in accordance with all statutes, laws, and regulations.
